Terms of Service

These Terms of Service ("Terms") govern your use of the Parichay mobile application ("App"), operated by Pixel Pundit (ABN 89 110 117 979) ("Parichay", "we", "us"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The Service

Parichay is a marketplace platform that connects customers with independent service providers for cultural and community events in Australia. We facilitate discovery, communication, booking, and secure payment — we do not provide the services listed on the platform.

Providers are independent contractors, not employees, agents, representatives, or partners of Parichay. We do not direct, control, or supervise the manner in which providers perform their services.

2. Accounts

  • You must be at least 18 years old to use Parichay.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You agree to provide accurate, current, and complete information and to update it as needed.
  • You may not create multiple accounts, share accounts, or transfer your account to another person.
  • We may suspend or terminate accounts that violate these Terms, with notice where practicable.

3. Bookings

Customers:

  • You agree to provide accurate booking details and pay the agreed price for services booked through the platform.
  • Booking requests are not binding until accepted by the provider.

Providers:

  • You agree to deliver services as described in your listing, respond to booking requests within a reasonable time, and maintain accurate business information.
  • You must hold a valid ABN where required by Australian tax law.
  • You are solely responsible for the quality, legality, and safety of the services you provide.
  • You must hold appropriate insurance and licences where required by law for your service category.

4. Payments & Fees

  • Payments are processed securely by Stripe. By making a payment, you agree to Stripe's terms of service.
  • All prices are displayed in Australian Dollars (AUD) and are inclusive of GST where applicable.
  • Parichay charges a platform service fee on each transaction. The exact fee amount is clearly disclosed to both parties before payment is confirmed.
  • Deposit amounts and final payments are agreed between customer and provider at booking time.
  • We do not store your payment card details — all payment data is handled by Stripe (PCI DSS Level 1 certified).

5. Cancellations & Refunds

  • Cancellation terms are set by individual providers and clearly displayed at booking time before you confirm.
  • If a provider cancels a confirmed booking, you will receive a full refund of any deposit or payment made.
  • Refunds are processed via Stripe to your original payment method, typically within 5–10 business days.

6. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded by law. This includes guarantees that services will be:

  • Rendered with due care and skill
  • Fit for a particular purpose (where that purpose is made known)
  • Supplied within a reasonable time

If a service provided through Parichay fails to meet a consumer guarantee, you are entitled to remedies under the ACL, which may include a refund, compensation, or having the service re-performed.

These guarantees apply to the service provider. As a marketplace platform, Parichay facilitates the connection but does not itself provide the underlying services.

7. Disputes & Resolution

If you have a dispute with a provider or customer:

  1. Contact the other party directly via in-app messaging
  2. If unresolved within 48 hours, raise a formal dispute through the App — Parichay will review evidence from both parties and aim to mediate a fair resolution within 14 days
  3. If you are not satisfied with the outcome, you may escalate to:
    • Your state or territory consumer affairs or fair trading body:

Nothing in this clause limits your rights to take legal action.

8. Limitation of Liability

To the maximum extent permitted by law, and subject to Section 6 (Australian Consumer Law):

  • Parichay acts solely as an intermediary platform. We do not guarantee the quality, safety, legality, or availability of services listed by providers.
  • We do not endorse any provider, their qualifications, or their services.
  • We are not liable for disputes between customers and providers beyond our role as mediator.
  • We do not guarantee uninterrupted or error-free access to the App.

Our total aggregate liability to you for any claims arising from these Terms or your use of the App is limited to the greater of: (a) the platform fees you have paid to Parichay in the preceding 12 months, or (b) AUD $100.

This limitation does not apply to liability that cannot be excluded under Australian law, including liability for personal injury or death caused by our negligence, fraud, or breach of consumer guarantees under the ACL.

9. Prohibited Conduct

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable Australian law
  • Post false, misleading, defamatory, or discriminatory content
  • Circumvent the platform to avoid fees (e.g., arranging direct payment after connecting through Parichay)
  • Scrape, copy, reverse-engineer, or create derivative works from the App
  • Harass, threaten, or discriminate against other users
  • Upload malicious software or interfere with App security

Violation may result in account suspension or termination. We will provide notice and an opportunity to respond before permanent termination, except where immediate action is necessary to protect user safety or comply with law.

10. Intellectual Property

All content, trademarks, and intellectual property in the App are owned by Parichay or its licensors. Providers retain ownership of their uploaded photos but grant Parichay a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute them within the App for the purpose of promoting their services. This licence terminates when the provider deletes the content or their account.

11. Force Majeure

Neither party is liable for failure to perform obligations under these Terms caused by events beyond reasonable control, including natural disasters, pandemic, government action, internet outage, or third-party service failure (e.g., Stripe or Supabase outage).

12. Governing Law, Changes & Severability

These Terms are governed by the laws of the State of Victoria, Australia. Subject to your rights to escalate to consumer affairs bodies (Section 7), any disputes will be subject to the non-exclusive jurisdiction of the courts of Victoria.

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 14 days before the changes take effect. If you do not agree to the updated Terms, you may delete your account before they take effect. Continued use after the effective date constitutes acceptance.

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
